1. Acceptance
By using Bureau483 you agree to these terms. If you do not agree, do not use the service. Use by your employees or agents binds your firm.
2. The Service
Bureau483 provides FDA enforcement intelligence derived from public FDA records. Intelligence is for your firm's internal business development purposes only. Bureau483 is not legal advice, regulatory advice, or a prediction of FDA action. Bureau483 does not represent or speak for the FDA or any regulatory agency.
3. Account and Eligibility
You must be 18 or older to use Bureau483. You must provide accurate registration information. You are responsible for maintaining account security. Notify [email protected] immediately of any unauthorized access.
4. Territory Licenses
One territory license per firm per defined region. Exclusivity means no competing FDA consulting or remediation firm may purchase the same territory during your active term. Licenses are annual, non-transferable, and non-refundable after the 14-day initial period. Territory definitions are published at bureau483.com/territories. Bureau483 reserves the right to correct territory definitions that contain geographic errors, with notice to affected license holders. Founding Partner rates are permanently locked as specified in the written agreement.
5. Acceptable Use
You may use Bureau483 intelligence for your firm's internal business development. You may not resell, redistribute, or sublicense Bureau483 intelligence to third parties. You may not use Bureau483 to harass, stalk, or make misleading contact with any facility or individual. You may not attempt to re-identify individuals from facility or inspection records. You may not scrape, bulk-download, or systematically copy Bureau483 output. You may not use Bureau483 in violation of CAN-SPAM, TCPA, or any applicable law. See bureau483.com/acceptable-use for detailed guidelines.
6. Payment and Renewal
Licenses are billed annually in advance. Payment is processed by Stripe. Licenses auto-renew unless cancelled in writing at least 30 days before the renewal date. No refunds after the first 14 days of a new license term. Founding Partner rates are permanently locked as documented in writing at time of agreement.
7. Intellectual Property
Bureau483 intelligence reports, scoring methodology, and platform are owned by Sui-Generis LLC. FDA source data is public; Bureau483's analysis, scoring, CFR mapping, and presentation are proprietary. You may use output for internal BD purposes but may not copy it at scale or reproduce it publicly without written permission.
8. Disclaimer of Warranties
Bureau483 is provided as-is without warranty of any kind. We do not warrant the completeness, accuracy, or timeliness of FDA source data, which is controlled by the FDA. We do not guarantee any business outcome from using Bureau483 intelligence.
9. Limitation of Liability
Bureau483's total liability to you is limited to fees paid in the prior 12 months. We are not liable for indirect, consequential, incidental, or punitive damages. Some jurisdictions do not allow these limitations — in those cases liability is limited to the maximum extent permitted by law.
10. Termination
Either party may terminate with 30 days written notice. Bureau483 may terminate immediately for material violations of acceptable use without refund. Upon termination, access ends and data handling follows the privacy policy.
11. Governing Law
These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Disputes will be resolved in the courts of Tennessee.
12. Changes
We will notify license holders of material changes 30 days in advance by email. Continued use constitutes acceptance. Non-material changes (typos, formatting) may be made without notice.
